  • Acceptance of Terms

    These Terms & Conditions (“Terms”) govern your access to and use of the Thumdar.com website, services, community spaces, downloadable content, and any related features (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

  • Definitions

    For purposes of these Terms, “Thumdar,” “we,” “us,” or “our” means Thumdar.com, owned and operated by Domenick Basolo; “User,” “you,” or “your” means any individual or entity that accesses or uses the Service; “Content” means all text, images, video, audio, code, or other materials available on or through the Service; and “User Content” means Content that a User submits, posts, or otherwise makes available through the Service.

  • Eligibility and Account Security

    You must be at least 18 years old to use the Service. You agree to provide accurate, current, and complete registration information and to update it promptly. Keep your password and credentials confidential; you are responsible for all activity under your account.

  • Acceptable Use

    You will not use the Service to harass, threaten, bully, or defame; to post hate speech, pornography, or graphic violence; to upload malware or other harmful code; to impersonate others or misrepresent your affiliation; to send unsolicited promotions without our prior written consent; or to violate any applicable law, regulation, or third-party right. We may remove content and suspend or terminate accounts that violate these standards without prior notice.

  • User Content and License to Thumdar

    You retain ownership of your User Content. By posting User Content, you grant Thumdar a worldwide, royalty-free, non-exclusive, perpetual license to reproduce, modify, adapt, publish, translate, distribute, perform, and display such Content as necessary to operate and promote the Service. You represent that you have all rights needed to grant this license and that your User Content does not infringe any third-party rights.

  • Downloadable Content; EULA; “Free-For-All, Always”

    All downloadable software and digital assets are governed by our End-User License Agreement (EULA). We grant you a non-exclusive, non-transferable, revocable license to use downloads for personal, non-commercial purposes, subject to the EULA. Except where expressly permitted, you may not sublicense, sell, redistribute, reverse-engineer, decompile, or modify downloads. Downloads are provided “AS IS” without warranties. All Thumdar-hosted downloads are permanently free; you may not charge for or restrict access to any Thumdar-hosted download.

  • Intellectual Property

    Trademarks: “Thumdar™” – Serial No. 99218753 (pending) and “Giggles™” – Serial No. 99329307 (pending; intent-to-use) are U.S. trademark applications owned by Domenick Basolo. The bold red “T” logo and related brand assets are proprietary. Do not use our marks without prior written permission.

    Copyright: All original content, custom designs, branding, and software code created for Thumdar.com are protected by copyright law.

  • Infringement Notices (DMCA)

    Thumdar has designated a DMCA Agent under 17 U.S.C. § 512. Send all notices of claimed copyright infringement and counter-notifications to:

Notices of Claimed Infringement (17 U.S.C. § 512(c)(3))

A notice must include: (1) your full legal name, mailing address, telephone number, and email address; (2) identification of the copyrighted work claimed to have been infringed, or a representative list for multiple works; (3) identification of the material to be removed or disabled, with information reasonably sufficient to locate it on our site (for example, specific URLs); (4) a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (5) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf; and (6) your physical or electronic signature. We will provide your name, contact information, and the contents of your claim to the person or entity who posted the content so they can evaluate or respond. Send notices to the Designated Agent by email or mail using the details above.

Counter-Notifications (17 U.S.C. § 512(g))

If your material was removed or disabled and you believe this was a mistake or misidentification, your counter-notification must include: (1) your full legal name, mailing address, telephone number, and email address; (2) identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before removal or disabling; (3) a statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled due to mistake or misidentification; (4) your physical or electronic signature; and (5) a statement that you consent to the jurisdiction of the United States District Court for the District of Nebraska and will accept service of process from the person who submitted the original notice or that person’s agent. Upon receipt of a compliant counter-notification, we will provide a copy to the complainant and may restore the material 10–14 business days later unless we receive notice that the complainant has filed a court action seeking to restrain the allegedly infringing activity.

  2. Privacy and Data Protection

    We process personal data as described in our Privacy Policy and applicable laws (including CCPA/CPRA, NDPA, Nevada Consumer Health Data Privacy, and others). We collect registration data, usage data, and User Content; use cookies and similar technologies for functionality and analytics; and retain data as needed for operations, legal compliance, and legitimate business purposes. California, Nebraska, and Nevada residents may request access, correction, deletion, or restriction by contacting legal@thumdar.com. We do not knowingly collect data from users under 18.

  3. Accessibility

    We strive to meet recognized accessibility standards. If you encounter barriers, email webmaster@thumdar.com.

  4. Safety and Security

    We employ industry-standard technical and organizational measures to protect data, but no system is impenetrable. You are responsible for maintaining strong passwords and safeguarding your credentials.

  5. Enforcement; Suspension; Bans; Appeals

    We may remove content, suspend, or terminate access for violations of these Terms or our policies, without prior notice. To appeal a suspension or ban, email webmaster@thumdar.com within 14 days with your account details and the reason you believe the enforcement was in error.

  6. Communications

    By creating an account, you consent to receive transactional messages (for example, password resets and security alerts) and promotional emails. You may opt out of promotional emails via the unsubscribe link in any message.

  7. Disclaimers of Warranties

    To the fullest extent permitted by law, the Service and all Content are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

  8. Limitation of Liability

    To the fullest extent permitted by law, Thumdar, its owner, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including lost profits, arising out of or in connection with these Terms or your use of the Service, even if advised of the possibility of such damages.

  9. Indemnification

    You agree to indemnify, defend, and hold harmless Thumdar and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, or infringement of any third-party rights.

  10. Governing Law and Venue

    These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Sarpy County, Nebraska.

  11. Changes to These Terms

    We may amend these Terms at any time. The revised Terms will be posted with an updated “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
